2. Scope of Application

These terms and conditions apply to all offers and contracts made via michaelbarnaart.com between Michael Barnaart and the consumer.

3. Product Information

Our collection is handmade. Slight variations or imperfections are part of the artisanal process and do not constitute grounds for cancellation or refund.

4. Prices and Payment

All prices include VAT and exclude shipping costs. Full payment must be received before shipment.

The customer has the right to cancel the purchase within 14 days of receiving the order. Returned products must be unused, undamaged, and in original packaging. Return shipping costs are borne by the customer.

We provide a six-month warranty covering manufacturing defects. Wear and tear or misuse are not covered under this warranty.

9. Force Majeure

In case of force majeure (strikes, natural disasters, pandemics, transport issues), we may delay delivery or cancel the contract without liability.

10. Complaints

Complaints can be submitted by email and will be addressed within 7 business days. We aim to resolve all issues amicably.

11. Intellectual Property

All designs, images, texts, and content on michaelbarnaart.com are protected by copyright. No part may be copied, reproduced, or used without written permission.

12. International Shipping

The customer is responsible for any import duties, customs charges, or local taxes outside France.

13. Refusal of Orders

We reserve the right to refuse or cancel orders in case of obvious pricing errors, misuse, or suspected fraud.

14. Changes to Terms

We may update these terms at any time. Changes take effect upon publication on the website.

15. Disclaimer

Use products as intended. Not suitable for children. Keep away from fire. Some brooches contain small parts that may pose a choking hazard. Magnetic closures may pose a risk for individuals with pacemakers.

16. Governing Law and Jurisdiction

These terms are governed by French law. Any disputes shall be brought before the Tribunal judiciaire d’Auch. Consumers may also use the European ODR platform: ec.europa.eu/consumers/odr
